Compensation for functional limitation

Compensation for functional limitation is paid if a permanent general functional limitation is caused by an occupational accident or disease. A functional limitation is considered permanent when an improvement in the condition of the injury or ailment is no longer considered medically probable.

Compensation for functional limitation does not have to be applied for separately. Mela evaluates the eligibility for compensation based on medical reports.

Determining the amount of the compensation for functional limitation

The amount of the compensation for functional limitation is determined on the basis of the disability category and the basic amount according to the table provided in the Government decree on disability categories. The disability categories are numbered from 1 to 20 and describe the degree of functional limitation caused by the injury or illness.

The injured person’s occupation, hobbies, living conditions or other individual circumstances do not affect the amount of compensation. However, any improvement made to the person’s abilities with the help of an artificial joint, prosthesis or other aid is taken into consideration.

If the injury or illness deteriorates or improves, the disability category may change and the amount of compensation reassessed accordingly.

Payment

Compensation for functional limitation can be paid no earlier than one year after the accident or the manifestation of the occupational disease. Even after one year, compensation is paid only if the injury or illness can be considered to be permanent.

Compensation is paid in accordance with the disability categories as follows:

  • One-time payment for categories 1–5
  • Continuous compensation for categories 6–20

Compensation for functional limitation is tax-exempt.

For occupational accidents and occupational diseases that occurred or were manifested before 1 January 2016

Compensation for functional limitation is paid in accordance with the Farmers’ Accident Insurance Act using the disability categories stipulated in the decree of the Ministry of Social Affairs and Health. Compensation for functional limitation is paid as a lump sum for disability categories 1–10. If your disability category is above 10, you can choose to have the compensation paid as a lump sum or as continuous compensation.
